Terms & Conditions
General:
The purchase of goods and/or services from Newbridge Heating Centre Ltd is subject to the following terms and conditions.
Any order made by you is an acknowledgement by you that:
a) You accept these terms
b) You agree that you have entered into a legal contract with NHC Ltd.
c) These terms, together with your order constitute the entire agreement between you and Newbridge Heating Centre Ltd for the supply of goods and/or services.
NHC Ltd is registered to resell and install Fireplaces, Stoves, Chimney Systems, Heating & Plumbing Equipment and associated accessories. NHC Ltd does not accept any responsibility or liability where customers / buyers elect to install products themselves or use non qualified persons to install upon their instruction. Also note that product warranties may also be invalidated where products are incorrectly installed and / or installed by non qualified persons.
Installation:
Once an order has been acknowledged and deposit paid we will advise delivery and where applicable the installation date / schedule. Installation dates are given in good faith, however if for reasons beyond our control we have to rearrange the date (example: safety issues due to adverse weather conditions) we will rearrange by consent the earliest possible alternative. We shall not be held responsibility for any liability for any direct or indirect costs / losses as a consequence of the date change.
Where we have taken delivery of goods against a customer order and have agreed in principle an installation date then the customer defers the delivery and / or installation date beyond that agreed, we reserve the right to request the balance of payment in full be paid by the original delivery / install date.
Purchaser / buyer must be on site at time of completion of installation to be instructed on the correct usage of the appliance / system, and handed all associated relevant documentation.
Chimneys / Flues:
NHC Ltd will advise the customer / buyer on the suitability of existing chimneys and the selection of chimney components to ensure each installation complies with the respective manufacturer’s recommendations, legislation covering safety and current law applicable to installing any of the products selected and purchased by the buyer. NHC Ltd takes no responsibility for any performance shortcomings associated with existing chimneys / flues. In the event of wind related chimney issues (downdraught’s) we will recommend / specify the appropriate solutions for the purchaser / buyer. Any associated costs will the sole responsibility of the purchaser / buyer.
Existing / Old Chimneys / Flues:
All existing chimneys should be professionally swept / inspected prior to the installation of any new fireplace / stove. This should be carried out by an independent third party. We do not carry out video inspection of existing flue linings. In some cases we will recommend that this level of inspection be carried out by an independent third party. Any associated cost for such inspections will be the responsibility of the purchaser / buyer.
Prefabricated Flues:
Where a new prefabricated flue system is required the purchaser / buyer is solely responsible for seeking advise from local authority that this is permitted and if necessary obtain planning approval prior to committing to purchase / installation.
Fireplaces:
Stone fire surrounds may vary slightly from ones seen in showroom or from manufacturer’s brochures. New fireplaces are supplied and installed, suitable for specific fuel burning, based on client discussions in showroom and/or site survey.
NHC Ltd takes no responsibility for the removal of existing fireplaces. There is always a risk of breakage associated when removing an existing
fireplace. Although no guarantees can be given, we will take every effort to prevent unwanted breakages.
Where NHC Ltd removes an old fireplace and replaces it with a new fireplace, we will make good the plasterwork around the new surround as necessary. We will leave the wall ready for sanding / painting as necessary. Where finished flooring needs to be altered, we will advise at time of survey / order the specific needs and agree on a plan for post fireplace installation.
Gas Fire / Stoves / Cookers:
Room must be ventilated in accordance with IS813 standards. We will advise on specific ventilation requirements required for relevant products
at the time of purchase. Existing gas lines must be live and of sound integrity at time of installation. We will carry out relevant tests on pipe work as part of installation. Any problems / inadequacies identified with the gas supply lines at this stage will be assessed in terms of rectification. We will recommend / specify the appropriate solutions for the purchaser / buyer. Any associated costs will the sole responsibility of the purchaser / buyer. All works will be fully tested and certified to IS813 standards upon completion.
Gas Supplies:
All existing natural gas lines must conform to IS813 domestic gas standards. Where NHC Ltd are conducting work on site we will carry out all relevant tests and inspections required to ensure that the gas supplies conform to standards and are suitable for use. Existing live gas lines must be free from blockage and obstruction. All existing gas lines must be of sound quality and conform to soundness testing. Gas lines must be capable of delivering the appropriate volume of gas. Gas lines must be earth bonded as necessary. Where problems are identified with existing gas supplies NHC Ltd will identify and implement a solution, based on the approval of the purchaser / buyer. Any associated costs involved will be the sole responsibility of the purchaser / buyer.
Fuel:
NHC Ltd will advise the purchaser / buyer on suitable fuels to be used in wood burning and multi fuel burning appliances. Only approved fuels
should be burned in appliances. Smokeless fuels must only be burned in smoke controlled zones as dictated by local council. When burning wood or peat turf it is imperative that the fuel is properly seasoned or kiln dried so the moisture content is below 20%. Burning fuel with excessive moisture content will compromise both the performance of the appliance, and any potential warranty claim associated with said appliance.
Plumbing / Heating:
During on site works NHC Ltd will take every action possible to ensure that existing heating / plumbing equipment is left is safe working condition. We will endeavor to test and inspect this equipment as part of our commissioning work. NHC Ltd will not be held responsible for existing / old pipe work, valves, tanks, radiators pumps and boilers that may remain in place and integrate as part of new / upgraded systems. In the event of such failures we will recommend / specify the appropriate solutions for the purchaser / buyer. Any subsequent failure of existing equipment will be the sole responsibility of the purchaser / buyer. NHC Ltd shall not be liable for any consequential loss, damage, or liability which has not been directly caused by the negligence of the company.
Sub-Contractors:
The Company reserves the right to employ such sub contractor as the Company may nominate to carry out the installation work.
Warranties
• A one year statutory warranty applies to all products in respect of defective materials and / or workmanship from the manufacturer. Where other warranties apply we will advise the purchaser / buyer accordingly.
• All workmanship associated with installation works will be covered under warranty for a period of one year from date of original installation.
• It is the purchaser / buyers sole responsibility to read and understand fully the operating instructions prior to installation and use of any appliance / system.
• Exclusions: Defects or breakages due to negligence, willful damage, fair wear and tear, improper use of the product / system, use of incorrect fuels, alteration or unauthorized repairs to the product and installation by non qualified person(s).
• The customer must notify us within 7 days of delivery of the product if a defect has been found that was not apparent upon delivery or signing acceptance of the product.
• Where a valid claim under warranty is notified to us in accordance with our conditions we reserve the right to repair or replace the defective part(s) or replace the product at our discretion. Our liability is limited to the repair / replacement cost and we shall not accept any claim for consequential loss.
• Parts or replacement products supplied / fitted under warranty qualify for the outstanding period of the original 12 months statutory warranty, and do not qualify for a new or extended warranty period.
• We shall not accept any liability for any direct or indirect loss or loss of profits or damages arising due to defective, damaged or incorrectly supplied goods. This does not affect your statutory rights.
Payment Terms:
Payment: by cash, cheque, bank draft and credit / debit card.
Please note card payments must be made in store using chip / pin security.
All cheques to be made payable to Newbridge Heating Centre Ltd.
A non-refundable deposit of 30% of total order value is required on all orders placed.
Prices are determined at the time of order, and prior to payment of deposit are subject to change without notice.
On all orders where deposits have been received the balance is to be paid is full upon completion of delivery and / or installation.
Payment must be paid in full to the fitter at time of installation.
The title of goods remains that of NHC Ltd until payment is received in full.
Cancellations:
Should you decide for any reason to cancel your order at any time we reserve the right to withhold the non-refundable 30% deposit and claim other costs as reasonable to cover costs incurred by us, including full invoice cost if the goods have been manufactured and / or delivered to us against your order.
Return and Refund Policy:
Where goods have been correctly supplied against purchaser / buyer orders and purchaser / buyer subsequently decides the consignment wither in full or in part is not required for whatever reason it is entirely at out discretion if we accept the return in full or part and offer a refund.
Product regarded by us as “special order” will not be accepted for return or refund. Where we agree for goods to be returned for refund the cost of returning the goods in full is the responsibility of the sender as is any consequential loss of damage in transit. We will only sign for and accept goods returned to our postal address if goods are in original unopened packaging, show no sign of damage however caused and we have conditionally agreed in writing to accept the goods. A minimum administration fee of €35.00 will be payable per transaction and the non-refundable deposit of 30% as stated above will apply.
